This waiver and release of liability (the "Waiver") pertains to the use of The Yard Cafe & Dog Park (the "Dog Park") located at 1115 West Lenoir St. Raleigh, NC. All individuals who wish to become members and use the Dog Park must agree to the terms and conditions set forth below.

Acknowledgment of Specific Risks: I acknowledge that the use of The Yard Cafe & Dog Park (the "Dog Park") located at 1115 West Lenoir St., Raleigh, NC, involves inherent risks. These risks include, but are not limited to, injuries or damages caused by bites, scratches, or other actions by dogs, injuries from falls or collisions, or injuries due to the actions or inactions of other guests. I understand that these risks cannot be completely eliminated without jeopardizing the essential qualities of the activity.

Specific Assumption of Risk: I expressly understand and agree that I, and any guests under my supervision, assume all risks associated with using the Dog Park, including but not limited to injuries to myself, my dog(s), and any accompanying minors.

Dog's Health & Behavior Warranty: I warrant that my dog(s) is in good health, is current on all vaccinations required by state and local regulations, and does not exhibit aggressive behavior towards humans or other dogs. I understand that if my dog(s) shows aggressive or unpredictable behavior, it is my responsibility to immediately remove my dog(s) from the Dog Park.

Limited Release & Waiver: I hereby release and discharge The Yard Cafe & Dog Park, its employees, agents, volunteers, and representatives from any liability for accidents, injuries, loss of property, or other damages that are the result of ordinary negligence. This release does not include gross negligence, willful or wanton conduct, or intentional wrongdoing on the part of The Yard Cafe & Dog Park.

Indemnification: I agree to indemnify and hold harmless The Yard Cafe & Dog Park from any claims, damages, or liabilities arising from any negligent, reckless, or intentional acts committed by me, my guests, or my dog(s).

Emergency Procedures: In the event of an emergency involving me or my dog(s), The Yard Cafe & Dog Park staff will first attempt to contact the emergency contact provided by me. If immediate medical or veterinary attention is required, staff may seek such services at my expense.

Photo & Video Release: I understand and acknowledge that during my visit to The Yard Cafe & Dog Park, photography, audio, and video recording by staff or authorized personnel may occur. While reasonable efforts may be made to accommodate individual requests not to be photographed or recorded, I understand that, due to the public nature of the park, such requests may not always be feasible. By entering the premises, I am giving consent for myself, my guests, and my dog(s) to be included in any such recordings. These recordings may be used for any lawful purposes related to The Yard Cafe & Dog Park's initiatives, including promotional materials, social media posts, and advertising. I hereby waive and release any claims I may have related to the use of recorded media of myself or my dog(s) on the premises, including, without limitation, any right to inspect or approve the photo, video or audio recording, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement, or for any fees for use of such record media.

Compliance with Rules and Policies Regarding Minors: I agree to abide by all rules and regulations of the Dog Park, including the policy regarding minors. I understand that guests must be aged 16 or older to enter the park area. Recognizing the risks outlined above, I, both personally and on behalf of any minor child under my supervision, willingly assume all risks associated with our use of The Yard Cafe & Dog Park. This includes any risks to personal injury or property damage that the minor child may experience or cause to others while participating in activities at The Yard. To the maximum extent permitted by law, I agree to hold harmless and indemnify The Yard Cafe & Dog Park, its owners, staff, volunteers, employees, and agents from any claims, causes of action, losses, or liabilities for any injury to person or property. This indemnification covers any such injury that said minor child may suffer, or for which said minor child may be liable to another party, arising from their participation in activities at The Yard. This indemnification applies to and includes all incidents or occurrences resulting from ordinary negligence, and is irrespective of fault.

Affirmation of Understanding: I affirm that I have read and fully understand this Waiver. I acknowledge that I am signing it freely and voluntarily, and intend by my signature to provide a complete and unconditional release of liability to the greatest extent allowed by law. I certify that I am 18 years of age or older and legally competent to sign this Waiver.
